WAIVER and RELEASE
This Agreement is between the individual participant signing below (the “Participant”) and Urban Landmark Corporation
d.b.a. Kent Valley Ice Centre (“Ice Centre”), Kent Valley Hockey Association (“KVHA”), the City of Kent, and their
respective parents, subsidiaries, affiliates, directors, officers, employees, agents, volunteers, successors, and assigns,
together with any sponsors or promoters of the activities (collectively, the “Releasees”).
In consideration for the opportunity to purchase ice, hold events, enter the premises, attend, volunteer, spectate,
and/or participate in activities offered, provided, or made available at or in connection with the Kent Valley Ice Centre or
Kent Valley Hockey Association (the “Activities”), Participant agrees as follows:

ACTIVITIES & RISKS
The “Activities” include, but are not limited to, hockey-related activities and ice skating, including tryouts, evaluations,
practices, games, scrimmages, camps, clinics, instruction, training sessions, warm-ups, drills, and related on-ice and off-
ice activities, as well as spectating, recreation, and any other individual or group activities or events conducted by or at
Kent Valley Ice Centre or in connection with the Activities.
The Activities may occur at the Kent Valley Ice Centre, including ice surfaces, locker rooms, hallways, spectator areas,
parking lots, and surrounding areas, as well as any other location associated with the Activities.
Participation in the Activities may involve full or partial contact, use of equipment, interaction with other participants,
and inherent risks associated with ice surfaces, and requires appropriate physical and mental fitness.
THE ACTIVITIES ARE INHERENTLY HAZARDOUS AND DANGEROUS.
Participation exposes the Participant to risks of serious bodily injury, including permanent disability, paralysis, or death
(the “Risks”). Such Risks include, but are not limited to:
• contact with other participants or spectators
• collisions with boards, glass, equipment, or fixed objects
• falls or mishaps on ice or surrounding surfaces
• rough play or physical contact
• adverse weather conditions
• communicable illness or disease
• flying pucks, sticks, or other equipment
• defects in equipment or facilities
• negligent instruction, supervision, or maintenance.
Risks may arise from the actions or inactions of the Participant, other participants, spectators, including the active or
passive negligence of the Releasees. Some Risks cannot be predicted or controlled, and additional risks and losses may
occur that are not known or foreseeable at this time.

WARRANTIES & REPRESENTATIONS
Participant represents that he or she is physically and mentally able to participate in the Activities and has no medical
condition that would impair participation or be aggravated by participation.
Participant agrees to discontinue participation immediately if he or she believes conditions to be unsafe.

LIKENESS & PUBLICITY
The Releasees shall have the perpetual and irrevocable right to use, reproduce, publish, and disseminate the
Participant’s name, image, voice, appearance, and other identifying information (“Likeness”) obtained in connection
with the Activities in any media for promotional or informational purposes.
Participant acknowledges that the Releasees shall own any photographs, video recordings, or other media created in
connection with the Activities.

RELEASE & INDEMNIFICATION
Participant understands and knowingly and freely assumes the Risks associated with the Activities, whether or not
expressly described herein. Participant acknowledges receiving material benefit from the Activities and, in consideration,
agrees, to the fullest extent permitted by law, to:
(i) WAIVE, RELEASE AND DISCHARGE the Releasees from any and all liability, claims, damages, losses, expenses,
demands, suits, actions, fines and/or judgments, including without limitation reasonable attorneys’ fees, court costs and
litigation expenses (collectively, the “Claims”), related to or arising from the Activities, including but not limited to bodily
injury, personal injury, death, discrimination, property damage, or the active or passive negligence of the Releasees; and
(ii) INDEMNIFY, DEFEND AND HOLD HARMLESS the Releasees from any Claims asserted against the Releasees arising
out of or related to Participant’s involvement with the Activities.
This waiver and release applies to any claims brought by the Participant or by any family member, heir, estate, personal
representative, or other person acting on the Participant’s behalf.

ENTIRE AGREEMENT
Participant acknowledges that this Waiver and Release constitutes the entire agreement with respect to the matters
addressed herein and that Participant understands its terms and signs it voluntarily.
If any portion of this Waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full
force and effect.

PARENTAL CONSENT (FOR MINORS)
If the Participant is under the age of eighteen (18), the undersigned parent or legal guardian represents that he or she
has the authority to execute this Waiver on behalf of the minor and agrees to be bound by its terms.
The parent or guardian further agrees to release and indemnify the Releasees from any claims arising from the minor’s
participation in the Activities.
